HOUSE CONCURRENT RESOLUTION NO. 42

Requesting the joint committee on government and finance to make
a study concerning the amendment of the state traffic
regulations and laws of the road for the purpose of
improving highway safety and conforming with interstate
traffic laws.
Whereas, West Virginia Code Chapter 17C, entitled "Traffic
Regulations and Laws of the Road," was last completely revised in
1951; and
Whereas, Interstate travel has increased dramatically since
1951, and equally dramatic have been changes and improvements in
road design, traffic control and vehicular design; and
Whereas, Highway safety is fostered if the regulations and
laws of the road are uniform from state to state to the extent
practicable; and
Whereas, The Legislature desires to promote highway safety to
reduce accidents, injuries, deaths and property damage;
therefore, be it
Resolved by the Legislature of West Virginia:
That the joint committee on government and finance is hereby
requested to review, examine and study the state traffic
regulations and laws of the road; the traffic regulations and
laws of the road of other states, with an emphasis on those
states adjacent to West Virginia; the current recommendations of
the Uniform Vehicle Code; and the highway and traffic engineering
research, particularly the WVDOH Research Project entitled
"Bringing Chapter 17C of the State Code Into Conformance with
Uniform Vehicle Code," dated October, 1995; with the aims of
improving traffic safety in the state of West Virginia, of
achieving uniformity with the laws of other states where
practicable, of eliminating obsolete provisions of West Virginia
Code Chapter 17C; and of making recommendations to the
Legislature regarding same; and, be it
Further Resolved, That the joint committee on government and
finance report to the regular session of the Legislature, 2000,
on its findings, conclusions and recommendations, together with
drafts of any legislation necessary to effectuate its
recommendations; and, be it
Further Resolved, That the expenses necessary to conduct
this study, to prepare a report and to draft necessary
legislation be paid from legislative appropriations to the Joint
committee on government and finance.
